truth® Triumphs Over Lorillard in Long Legal Battle
Dear Colleagues,

Our Board of Directors and staff are delighted to report that in a unanimous decision on July 17th the Delaware Supreme Court ruled in favor of the American Legacy Foundation by upholding a Delaware Chancery Court ruling that the foundation's truth® ads do not vilify or personally attack tobacco companies.

Despite the Delaware Chancery Court twice rejecting Lorillard's claims that the foundation violated the Master Settlement Agreement, Lorillard filed an appeal to the Delaware Supreme Court in November, 2005. In this latest decision, issued earlier this week, the Court ruled that although the daring and edgy advertising did in fact refer to tobacco companies, their executives and specifically Lorillard, claims that the ads vilify or personally attack Lorillard are without merit.

I'm just delighted that this five-year unfounded action against us has come to an end and that we have a license to save lives.
